Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Cheeky Parking, including our website, mobile app, maps, reports, notifications, subscriptions, and related services.

By creating an account, accessing, or using Cheeky Parking, you agree to these Terms. If you do not agree, you must not use the service.

1. The service

Cheeky Parking allows users to view and submit community reports about parking enforcement activity, including parking attendant sightings, ticket activity, and related map-based information. The service may also include activity layers, heat maps, alerts, scans, subscriptions, support features, and other tools.

The service is provided for general information and community sharing only. We do not verify every report and we do not guarantee the accuracy, completeness, timeliness, legality, safety, or availability of any information shown in the app.

2. Eligibility

You may use Cheeky Parking only if you are legally able to agree to these Terms and are old enough to use the service under the laws that apply to you.

Cheeky Parking is not intended for children under 13, or under the minimum age required by applicable law in your country.

3. Accounts

You may need to create an account to use some features. You agree to provide accurate information and keep your account details up to date.

You are responsible for:

• maintaining the confidentiality of your login details;
• all activity under your account;
• notifying us if you believe your account has been compromised; and
• ensuring your use of the service complies with these Terms.

We may suspend, restrict, or terminate accounts where we reasonably believe there has been misuse, unlawful activity, abuse, security risk, or breach of these Terms.

4. Your responsibilities

When using Cheeky Parking, you agree that you will:

• comply with all applicable laws, road rules, traffic regulations, and parking restrictions;
• check official parking signs, restrictions, payment requirements, and local rules before parking;
• purchase a valid parking ticket, permit, or parking session where required;
• not park illegally, dangerously, obstructively, or in a way that may cause harm or disruption;
• use the app responsibly and safely;
• submit reports only where you genuinely believe the information is accurate;
• not submit false, misleading, malicious, abusive, unlawful, or harmful content;
• not identify, harass, threaten, shame, or target parking attendants, enforcement officers, drivers, or members of the public;
• not post personal data about others, including vehicle registration numbers, contact details, private addresses, or photos focused on identifiable people;
• not use the app while driving or in any unsafe manner;
• not scrape, copy, harvest, reverse engineer, interfere with, or overload the service;
• not attempt to bypass subscriptions, access controls, security measures, or rate limits; and
• not use the service for unlawful, fraudulent, or abusive purposes.

5. Community reports and user content

Users may submit reports, notes, feedback, locations, photos, or other content (“User Content”). You are solely responsible for your User Content.

By submitting User Content, you grant Cheeky Parking a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, publish, modify, moderate, anonymise, aggregate, distribute, and otherwise process that content as needed to operate, improve, promote, and protect the service.

You confirm that you have the right to submit any User Content you provide and that it does not violate the rights of any person or any law.

We may remove, hide, expire, moderate, edit, aggregate, anonymise, or limit User Content at our discretion, including where we believe it is inaccurate, unlawful, unsafe, abusive, irrelevant, or harmful to the community.

6. No reliance on app information

All reports, maps, alerts, heat maps, scans, and activity indicators are provided “as is” and for general information only.

You must not rely on Cheeky Parking as your sole or primary source of parking information. The app may show no reports even when enforcement is present, or may show reports when enforcement is no longer present. Reports may be delayed, incorrect, duplicated, malicious, incomplete, or affected by technical issues.

You are responsible for any parking fine, penalty charge notice, towing, clamping, vehicle removal, legal issue, payment failure, missed payment, incorrect permit, or other outcome arising from your parking decisions.

7. Parking, fines, and enforcement

Cheeky Parking does not encourage, assist, or authorise illegal parking, non-payment, avoidance of lawful charges, obstruction, unsafe parking, or breach of parking restrictions.

You should always pay for parking where payment is required and comply with all applicable restrictions. The app is not designed to help users evade lawful enforcement or avoid legal obligations.

To the fullest extent permitted by law, Cheeky Parking is not responsible for:

• parking fines;
• penalty charge notices;
• towing, clamping, or vehicle removal;
• parking ticket costs;
• missed or failed parking payments;
• incorrect parking decisions;
• reliance on inaccurate reports;
• changes to restrictions;
• enforcement action;
• disputes with parking authorities; or
• any direct or indirect consequences of where, when, or how you park.

8. Location, notifications, and device permissions

Some features require location, notification, camera, photo, or other device permissions. You can manage permissions through your device settings.

If permissions are disabled, some features may not work or may be less accurate. We do not guarantee that location, notification, scan, alert, or map features will be available, accurate, timely, or uninterrupted.

9. Subscriptions and paid features

Cheeky Parking may offer optional paid features, including subscriptions such as access to activity or heat map features.

Where subscriptions are offered:

• the price, billing period, renewal terms, and cancellation process will be shown in the app, app store, or payment flow;
• payments may be processed by Apple, Google, RevenueCat, or another payment provider;
• subscriptions may renew automatically unless cancelled in accordance with the relevant store or payment provider rules;
• refunds are handled according to the relevant app store or payment provider policies unless we state otherwise; and
• access to paid features may end if payment fails, a subscription expires, or an entitlement cannot be verified.

We may change, add, remove, limit, or discontinue paid features in accordance with applicable law and app store rules.

During beta testing or promotional periods, we may make paid features available for free or at a reduced price. Beta or promotional access does not guarantee continued free access.

10. Beta features

Some features may be released in beta, preview, testing, or experimental form. Beta features may be incomplete, unreliable, changed, removed, or made paid in the future. You use beta features at your own risk.

11. Acceptable use

You must not:

• use the service to harass, intimidate, track, or target any person;
• use the service to facilitate unlawful activity;
• submit deliberately false or malicious reports;
• upload unlawful, defamatory, abusive, discriminatory, threatening, obscene, or infringing content;
• interfere with the service or other users;
• attempt to gain unauthorised access to systems or data;
• use bots, scripts, scraping, or automated tools without permission;
• copy or resell the service or its data;
• bypass subscription controls or technical protections; or
• use Cheeky Parking in a way that could damage our reputation, systems, users, or community.

12. Moderation and enforcement

We may investigate, remove content, restrict features, suspend accounts, terminate accounts, or take other action where we reasonably believe there has been a breach of these Terms, risk to users, misuse of the service, legal issue, or security concern.

We are not obliged to monitor all content, but we may do so where appropriate.

13. Intellectual property

Cheeky Parking, including its branding, design, software, features, text, graphics, logos, and systems, is owned by us or our licensors and is protected by intellectual property laws.

You may use the app only as permitted by these Terms. You must not copy, modify, distribute, sell, reverse engineer, or create derivative works from Cheeky Parking except where allowed by law or with our written permission.

14. Third-party services

Cheeky Parking may rely on or link to third-party services, including maps, hosting, authentication, analytics, notifications, payment providers, app stores, and external websites.

We are not responsible for third-party services, their content, availability, accuracy, security, or privacy practices. Your use of third-party services may be subject to their own terms and policies.

15. Availability and changes to the service

We may change, suspend, restrict, or discontinue all or part of the service at any time. We do not guarantee that the service will be available, uninterrupted, secure, error-free, or compatible with every device or operating system.

16. Disclaimers

To the fullest extent permitted by law, Cheeky Parking is provided on an “as is” and “as available” basis.

We disclaim all warranties, representations, conditions, and guarantees, whether express or implied, including but not limited to:

• accuracy;
• completeness;
• timeliness;
• reliability;
• availability;
• fitness for a particular purpose;
• non-infringement;
• merchantability;
• safety;
• uninterrupted operation; and
• that use of the app will prevent fines, enforcement, towing, clamping, penalties, or other parking-related consequences.

Nothing in these Terms excludes or limits any rights that cannot be excluded or limited under applicable law.

17. Limitation of liability

To the fullest extent permitted by law, Cheeky Parking and its owners, operators, employees, contractors, service providers, and affiliates will not be liable for:

• parking fines;
• penalty charge notices;
• towing, clamping, or vehicle removal;
• parking charges or unpaid parking fees;
• vehicle damage, loss, or inconvenience;
• legal consequences of parking decisions;
• reliance on inaccurate, incomplete, delayed, or unavailable reports;
• loss of profits, revenue, goodwill, data, or opportunity;
• indirect, incidental, special, consequential, exemplary, or punitive damages; or
• any loss arising from use of or inability to use the service.

Where liability cannot be excluded, our liability is limited to the maximum extent permitted by law.

18. Indemnity

To the fullest extent permitted by law, you agree to indemnify and hold Cheeky Parking harmless from claims, losses, liabilities, damages, costs, and expenses arising from:

• your use or misuse of the service;
• your parking decisions;
• your User Content;
• your breach of these Terms;
• your breach of law or third-party rights; or
• your conduct in connection with the service.

19. Account deletion and termination

You may delete your account through the app settings where available or by contacting us.

We may suspend or terminate your access if we reasonably believe you have breached these Terms, created risk, misused the service, or if we need to protect users, the public, or Cheeky Parking.

After account deletion or termination, some provisions of these Terms will continue to apply, including provisions relating to User Content licences, disclaimers, liability limits, indemnity, and dispute provisions.

20. Privacy

Our Privacy Policy explains how we collect, use, store, and share personal information. By using Cheeky Parking, you acknowledge that personal information will be handled in accordance with our Privacy Policy.

21. Governing law

These Terms are governed by the laws of England and Wales, except where mandatory consumer protection laws in your country require otherwise.

The courts of England and Wales will have jurisdiction, except where applicable law gives you the right to bring claims in your local courts.

22. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify users, such as updating this page, changing the “Last updated” date, or providing an in-app notice where appropriate.

Your continued use of Cheeky Parking after updated Terms become effective means you accept the updated Terms, except where applicable law requires additional consent.
